Answer a witchcraft question from Google

Bright Blessings fellow Witches! Today we present to you another installment in our Answer a Witchcraft Question from Google Series. This post’s question is:

“Is it illegal for my employer to make a Pagan work on Halloween/Samhain in the USA?”

Let’s get into it.

First things first, almost every state in the US recognizes at-will employment. This means that employers are permitted to hire, promote, demote, or fire employees at any time and for any reason. And in the case of being fired, courts deny the employee any claim for loss resulting from the dismissal.

Now there are exceptions to the Employment at Will Act. The following exemptions to the act are that you cannot be dismissed due to:

  • Your gender, race, ethnicity, religion, or any other basis cited in the civil rights acts
  • Disabilities under the protection of the American with Disabilities Act
  • Filing complaints with OSHA – Occupational Safety and Health Act
  • Organizing a union, which falls under the protection of the National Fair Labor Practices Act

To answer the question above succinctly, no it isn’t not illegal for an employer to make a Pagan work on Halloween/Samhain. While these may seem or feel outrageous to hear, that’s just the way it is. This should not, however, discourage you from taking time off on the Sabbats.

If your place of employment is open on Sabbat days, then you may need to request the time off and use personal days in order to secure a leave of absence to observe the holidays. For employment in government agencies and the private sector, different rules may apply. Seek out your company’s policy in regards to religious observation and requesting time off.
